What Does The NSW Legislation Say?
The NSW Occupational Health And Safety Act clearly states that an employer must consult with their employees in relation to all issues affecting their health, safety or welfare. ( OHS Act - Section 13 ).
Employers can comply by having an OHS Committee, Safety Reps, or Other Agreed Arrangements. All Safety Committee members and Safety Reps must attend the Workcover NSW accredited training course. Clause 31 of the NSW OHS Regulation describes this requirement for training.
It should be noted that training must commence within 3 calendar months of employees being elected onto the committee.
